On 2 February 2026, the Supreme Court ordered a tribunal on the Pennaiyar river dispute. It involves Tamil Nadu and Karnataka. A bench of Justices Vikram Nath and N V Anjaria passed the order. Notably, the court gave the Union one month to issue the gazette notification. The tribunal will work under the Inter-State River Water Disputes Act, 1956. Hence, this long-pending case now moves to a specialised forum.
What the Supreme Court Ordered
The court told the Centre to form a tribunal “for the adjudication of the inter se water dispute”. Also, it returned Tamil Nadu’s plaint for presentation before that tribunal. According to AIR News, Justice Nath said there was no reason to delay forming the tribunal.
Tamil Nadu’s Case Against Karnataka
Tamil Nadu filed Original Suit No. 1 of 2018 under Article 131. It challenged Karnataka’s check dams and diversion works on the river. Specifically, it objected to projects on the main Pennaiyar and its tributary, the Markandeya. Tamil Nadu argued that water in an inter-state river is a national asset.
Karnataka’s Stand and Failed Talks
Karnataka is the upper riparian state, while Tamil Nadu is the lower riparian state. Karnataka said it plans to use 9.77 TMC of the 11.77 TMC in its catchment. So, it argued the remaining 2 TMC and surplus flows suffice for Tamil Nadu. However, the Centre’s negotiation committees failed twice to settle the matter. Later, Tamil Nadu declined a ministerial meeting fixed for 18 March 2025.
About the Pennaiyar River and the 1956 Act
The Pennaiyar, also called the South Pennar or Thenpennai, rises in the Nandi Hills of Karnataka. It then flows through Tamil Nadu and enters the Bay of Bengal near Cuddalore. Under Article 262, Parliament can provide for adjudicating interstate river disputes. Accordingly, Parliament enacted the Inter-State River Water Disputes Act, 1956. Under Section 4, the Centre forms a tribunal when negotiations cannot resolve a dispute.
